Furthermore, conflict of privacy and public rights in this area makes it more implicated and at the same time more susceptible. The main question of this paper is the principles of the Islamic criminal policy in dealing with crimes against morality. In response, with respect to the legal and jurisprudential resources, in particular the famous narrative by Faḍl ibn Shāḍān from Imam Riḍā (as), and the descriptive-analytical method, the paper reveals that this policy is a mixture one in which government and people cooperate. In practical approach, this policy can be illustrated through conception of “Enjoining good and forbidding wrong” and Jurisprudential rule of “Al-Ta'zīr (punishment) for all offenses and forbidden acts”. Moreover; other principles like the philosophy of formation and duties of Islamic government, prohibition of pretending to committing offences and forbidden acts and possibility of implementation of Ḥudūd for norm-violation justifies the necessity of interference of government in the field of moral security. The most reliable proof of this article is hadith of Faḍl ibn Shāḍān from Imam Riḍā (as) in which, explains mentioned principles.}, keywords = {Crimes against morality,Al-Ta'zīr,Implementation of Ḥudūd,Pretending to committing offences,Enjoining good and forbidding wrong,Islamic Government}, title_fa = {مبانی الزام حکومت به مبارزه با جرایم ضد اخلاق در کلام رضوی}, abstract_fa = {سیاست جنایی در قبال جرایم علیه اخلاق با توجه به اهمیت ذاتی آن از یکسو و حاکی‌بودن نوع و میزان حمایت حاکمیت از آنها بر جایگاه اخلاق در نظام سیاسی از سوی دیگر، دارای جایگاه خاص و ویژه‌ای می‌باشد که تلاقی دو عنوان حریم خصوصی و حقوق عمومی در این حیطه باعث پیچیده‌تر شدن و در عین حال حساس‌تر شدن آن می‌شود. سوال اصلی این نوشتار مبانی الزام حکومت در برخورد با جرایم علیه اخلاق است؟ در پاسخ به این سوال با تعمق در منابع فقهی و حقوقی خصوصا روایت معروف فضل بن شاذان از امام رضا(علیه السلام) و با روش توصیفی - تحلیلی مشخص می‌گردد که سیاست مذکور، یک سیاست ترکیبی متشکل از مردم و حکومت می‌باشد که در مقام عمل می‌توان آن را در ذیل اصل امر به معروف و نهی از منکر مشاهده و در قالب قاعده‌ فقهی «التعزیر لکل عمل محرم» تبیین نمود و مبانی دیگری چون فلسفه تشکیل و وظایف حکومت اسلامی، حرمت تظاهر به منکر و شمول حدود نسبت به متعدیان از مرزهای الهی را بدان افزود که با توجه به این مبانی حکومت اسلامی موظف به ورود به حیطه امنیت اخلاقی است. مستند اصلی این نوشتار عبارت است از روایت ابن شاذان از امام رضا(علیه السلام) که در آن حضرت در پاسخ به این سوال که اگر کسی بگوید چرا خداوند اولی‌الامر قرار داده و مردم را به اطاعت آنان فرا خوانده؟ مطالبی را ناظر به مبانی پیشگفته فرمودند.}, keywords_fa = {کلام رضوی,امنیت اخلاقی,حکومت اسلامی,تظاهر به منکر}, url = {http://www.farhangerazavi.ir/article_94047.html}, eprint = {http://www.farhangerazavi.ir/article_94047_586fe4e367d1eddc422dfdf3ec07c345.pdf} }
